There are a number of different ways to handle drug cases, and attorney Shawn Sweeney looks at each individual case before making any decisions. In state drug offenses, people are often arrested and immediately put in jail. That does not help you get the treatment you need, and it confines you to a life in jail. We will try to prevent you from being jailed or get you out of jail and into a drug treatment program followed by aftercare in a non-residential setting.
While seeking treatment on your own helps in court, it also helps in the case of a conviction. At sentencing, state courts are less inclined to reverse the treatment process by putting you back in jail.
If you can turn your life around in treatment, the prosecutor may agree to a “capped plea” where the judge can sentence you to an agreed-upon top sentence, but use their discretion to go below it.
At many sentencing hearings, we may bring in treatment counselors, family, and friends as positive character references.
